Coordination Council for Internet Development

I. General provisions

1.1.

This Regulations has been prepared in connection with execution of articles 10.46 and 10.50 of “Regulations on the Ministry of Communications and Information Technologies of the Republic of Azerbaijan” adopted by the Decree of president of the Republic of Azerbaijan dated August 10, 2004 and provisions of the Law “On Telecommunications” of the  Republic of Azerbaijan and regulates activity of the Coordination Council for Internet Development under the Ministry of Communications and High Technologies of the Republic of Azerbaijan (MCHT).

 

1.2.

Coordination Council for Internet Development (thereafter Coordination Council) under the Ministry of Communications and High Technologies of the Republic of Azerbaijan takes measures necessary for development of Internet, registration and use of domain names, and associated issues in the territory of the Republic of Azerbaijan, renders scientific-methodical assistance to the entities operating in this field and fulfils other tasks belonging to its competence.  

 

1.3.

Coordination Council carries out its activities in accordance with the Legislation of the Republic of Azerbaijan, as well as taking into account recommendations of the International Telecommunication Union, ICANN, IANA and other organizations operating in this area. 

 

1.4.

Coordination Council is under direct supervision of the minister of Communications and High Technologies of the Republic of Azerbaijan and reports to him. 

 

II. Objectives of the Coordination Council

2.1.

The main purpose of Coordination Council is to serve development of Internet in Azerbaijan. Coordination Council supports regulation of relations among entities communicating in this field and meeting the interests of parties, assists in the solution of issues regarding registration and use of domain names, carries out work in connection with preparing of proposals  on improving the legal framework and providing mass use of the Internet, working out of scientific-methodical materials on information security and fight against cybercrime on the Internet, awareness among users and other necessary activities.

 

III. Duties and functions of the Coordination Council

3.1.

Coordination Council has the following duties and functions: 

 

3.1.1.

to prepare proposals in connection with the development of Internet infrastructure and registration of domain names, monitor, analyse and propagate development processes;

 

3.1.2.

to determine opportunities for application of new Internet technologies in accordance with overall development policy of the country and international trends;

 

3.1.3.

to support coordination of activities of the entities having relation to this field;

 

3.1.4.

to prepare proposals on improvement of corresponding legislative database of the Republic of Azerbaijan; 

 

3.1.5.

to study world experience continuously and make recommendations on application of this experience to the Republic of Azerbaijan;

 

3.1.6.

to participate in the process of preparation and implementation of the projects of strategic development concepts in this field;

 

3.1.7.

to support and make relevant proposals for the provision of mass use of internet;

 

3.1.8.

to support in the provision of competitive conditions in this field;

 

3.1.9.

to take measures on the development of international relations in connection with development of internet infrastructure and registration of domain names;

 

3.1.10.

to perform awaresness work, organize Internet forums and  other activities in this field;

 

3.1.11.

to discuss contents that are allocated in the information resources existed in the global internet network and are contrary to government, historical, geographical, moral and national values, constitution, legislation of the Republic of Azerbaijan and international documents supported by it {has been changed by the decision of the board of MCIT dated 13.10.2008 with ref.number 10}

 

3.1.12.

to fulfill other responsibilities in connection with implemetation of paragraphs 10.46 and 10.50 of the Regulations on the Ministry of Communications and Information Technologies of the Republic of Azerbaijan; 

 

IV. Rights of the Coordination Council

4.1.

The Coordination Council has the following rights in connection with its fulfillment of  goals, duties and functions:

 

4.1.1.

to involve relevant organizations and officials in its activities, and solution of issues that are important for information society;

 

4.1.2.

to make a request on information, documents and other materials from physical and legal persons,  state agencies, their officials in cases and in a manner defined by the legislation;

 

4.1.3.

to create scientific-technical and other groups for the fulfillment of its duties;

 

4.1.4.

to make decisions within their authorities;

 

4.1.5.

to take other measures within their authorities.

 

V. Organization of the work of Coordination Council

5.1.

Regulations, composition of 9 members, chairman and secretary of this composition are approved by the decision of the body that created this Council. Changes made to the composition of the Coordination Council are made by the decision of the body that created this Council on the basis of statement of the Chairman of the Coordination Council. Candidates for membership of the Coordination Council are officially presented by the concerned bodies and operate publicly.

 

5.2.

Coordination Council builds its activity based on the principles of legality, transparency, joint leadership and impartiality.

 

5.3.

Chairman of the Coordination Council: 

 

5.3.1.

organizes the work of the Coordiantion Council and leads it;

 

5.3.2.

represents the Coordination Council;

 

5.3.3.

determines agenda of meetings of the Coordination Council and chairs meetings; 

 

5.3.4.

submits questions relating to the powers of the Coordination Council for the consideration at the meetings of the Coordination Council and uses other rights entrusted to it.

 

5.4.

Secretary of the Coordination Council 

 

5.4.1.

carries out organizational issues for the preparation of meetings of the Coordination Council, draws up agenda of meetings, necessary documents to be be discussed, projects of programs and submits to the members of the Coordination Council, and collects, analyzes and summarizes conclusions of the members of the Coordination Council on these issues;  

 

5.4.2.

if need be, ensures participation of the representatives of relevant organizations and other persons invited to the meetings of the Coordination Council;

 

5.4.3.

draws up clerical work and minutes of meetings of the Coordination Council, and submits projects of final documents of the meeting to the chairman of the Coordination Council;

 

5.4.4.

takes appropriate measures in connection with implementation of decisions adopted by the Coordination Council within its powers.

 

5.5.

members of the Coordination Council has the following rights:

 

5.5.1.

to participate at the meetings and discussions of the Cordination Council and express an opinion on the decisions to be adopted;

 

5.5.2.

to participate in the solution of issues relating to the powers of the Coordination Council and issues entrusted to it;

 

5.5.3.

to be familiar in advance with materials submitted to the meeting of the Coordination Council;

 

5.5.4.

to submit proposals on the issues related to the powers of the Coordination Council for the consideration at the meeting of Coordination Council;

 
 

5.5.5.

to get acquainted with decisions, minutes and other documents of the Coordination Council;

 

5.5.6.

to make protest in a written or oral form to the member of the Coordination Council, who did not notify the Coordination Council, if there are grounds specified in the article 5.6.5 of this Regulation;

 

5.5.7.

to use the rights granted to him by the other documents adopted.

 

5.5.4.

to make protest in a written or oral form to the member of the Coordination Council, who did not notify the Coordination Council, if there are grounds specified in the article 5.6.5 of this Regulation;

 

5.6.1.

to approach impartially to the issues reviewed at meetings of the Coordination Council;

 

5.6.2.

not to be absent at any meetings of the Coordination Council without good reason; 

 

5.6.3.

to avoid actions and speeches that may damage name of the member of the Coordination Council;

 

5.6.4.

Not to make public the essence of the issue until a decision has been adopted in the Coordination Council on considered issues;

 

5.6.5.

to inform the Coordination Council and not to participate at the adoption of decisions, if there are cases among the reviewed issues that may damage its personal or business interests or give a rise to its ill-will.

 

5.7.

members of the Coordination Council should observe the following ethical behavior within the framework of their activity in the Coordination Council:

 

5.7.1.

to follow Legislation of the Republic of Azerbaijan, these Regulations, rules determined by the internal documents of the Coordination Council and decisions and orders of the Coordination Council adopted within the framework of its powers;

 

5.7.2.

to follow privacy principles in the matters relating to the activities of the Coordination Council (issues, discovery of which are limited are determined by the chairman of the Coordination Council);

 

5.7.3.

to fulfill obligations in relation to the Coordination Council and other participants and participate in the implementation of activities of the Coordination Council;

 

5.8.

Meetings of the Coordination Council are held not less than once every three months. Meetings of the Coordination Council are considered plenipotentiary if more than half of the members participate there and decisions are adopted by simple majority vote. The meeting of the Coordination Council and decisions adopted there are formalized by the minutes signed by the chairman and secretary of the Coordination Council. Protests and comments are submitted in a written form and are attached to the minutes.

 

5.9.

The Coordination Council is independent in its activity and acts mutually on the basis of partnership with state and local authorities, as well as local, foreign and international non-governmental organizations during performance of its duties. Specialists of the relevant ministries and state committees, enterprises and organizations can participate at the meetings of the Coordination Council and its current work.

 

5.10.

If the chairman of the Coordination Council is not available to attend the meeting of the Coordination Council, then the meeting is chaird by a member selected by the members of the Coordination Council. 

 

5.11.

Information on the Coordiantion Council, as well as decisions adopted are posted on its official website.

2012 year

  • The enlarged meeting of the Council was held on April 12, (attended by CEOs of Internet providers). The meeting focused on the issues such as the provision of high-quality Internet services during Eurovision Song Contest 2012 in May in Baku, holding the 7th meeting of Internet Governance Forum (İGF) in the capital of Azerbaijan in November, the ICANN decisions, made at the final meeting of the organization. Moreover, the participants exchanged views on the draft “Rules of registration and use of top-level domain country codes in Azerbaijan”, prepared by the Council. As a result of discussions, appropriate decisions were adopted.
  • The Council held its next enlarged meeting on August 16 (attended by CEOs of Internet providers), which discussed the project of development of broadband services in the country. Following the meeting, appropriate decisions were adopted.
