Department of Transport Policy

 

1.

General provisions

 

1.1.

The Department of Transport Policy of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter – the Department) is a structural unit of the administrative office of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter – the Ministry), which provides activities on the formation of state policy in the field of transport.

 

1.2.

In its activities, the Department is guided by the Constitution of the Republic of Azerbaijan, international treaties to which the Republic of Azerbaijan is a signatory, the laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, “Regulations on the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan”, decisions, orders and instructions (hereinafter – organizational and administrative documents) of the Minister of Transport, Communications and High Technologies (hereinafter – the Minister), decisions of the Board of the Ministry and these Regulations.

 

1.3.

While carrying out its duties and exercising rights the Department interacts with structural divisions of the Ministry, bodies that are included in its structure and subordinate bodies that are not included in its structure.

 

2.

Activity areas of the Department

 

2.0.

The activities of the Department are as follows:

 

2.0.1.

makes proposals on identifying main areas of development in the relevant field;

 

2.0.2.

together with the structural units of the administrative office of the Ministry participates in the preparation of state programs in the relevant field, and within the limits of its authority, takes appropriate measures for their implementation;

 

2.0.3.

analyzes the transport policy implemented internationally, defines priorities for the national transport policy;

 

2.0.4.

analyzes the current state of the relevant field in the Republic of Azerbaijan, prepares forecasts for the priority areas of its development;

 

2.0.5.

makes proposals for reforms and structural changes in the relevant field and participates in the activities carried out in this direction;

 

2.0.6.

participates in improving the mechanism for regulating the activities of transport enterprises;

 

2.0.7.

participates in strategic planning and defining development priorities in the relevant field;

 

2.0.8.

participates in the evaluation of the effectiveness of projects scheduled for implementation in the relevant field;

 

2.0.9.

participates in working groups and project management groups for projects implemented in the relevant field, in project coordination and management;

 

2.0.10.

takes the initiative to develop regulatory documents, industry standards, guidelines, international and intersectoral agreements and other similar documents in the relevant field, update and properly sign or approve existing documents and participate in their implementation;

 

2.0.11.

prepares drafts of regulatory legal acts and industry standards on issues related to the competence of the department;

 

2.0.12.

makes proposals for the improvement the activities of the Department;

 

2.0.13.

ensures the implementation of the decisions of the Board of the Ministry, organizational and administrative documents and guidelines of the Ministry on issues within the competence of the Department;

 

2.0.14.

carries out activities in other areas as defined by law.

 

3.

Main duties of the Department

 

3.0.

The Department has following rights to fulfill its duties:

 

3.0.1.

to make proposals on the formation and implementation of a unified state policy in the field of transport;

 

3.0.2.

to make proposals on the improvement of the existing legal support in the field of transport, to develop drafts of legal acts for regulating developing relations in this area;

 

3.0.3.

to make proposals on strategic directions for accelerating international integration and economic development in the transport field;

 

3.0.4.

to make proposals on the organization of interaction with relevant state bodies with a view to developing and implementing a unified state policy in the field of transport;

 

3.0.5.

to participate in the development of development strategies in the field of transport;

 

3.0.6.

to participate in the development of innovative transport projects, sectoral and intersectoral programs, development concepts and other documents;

 

3.0.7.

to make proposals on transport reforms, improving the mechanisms of state regulation;

 

3.0.8.

to make proposals on measures to develop and increase the competitiveness of all transport corridors passing through the territory of the Republic of Azerbaijan;

 

3.0.9.

to analyze the information received from transport authorities, and make proposals for the implementation of projects aimed at developing and enhancing efficiency in this area, improving the quality of transport services;

 

3.0.10.

to participate in the implementation of bilateral and multilateral cooperation in the field of transport between the Republic of Azerbaijan and other countries;

 

3.0.11.

to develop drafts of legal acts in the field of transport and participate in their preparation;

 

3.0.12.

to give opinions on drafts of legal acts related to the transport field;

 

3.0.13.

to participate in the development and implementation of industry standards, guidelines, international and intersectoral agreements in the field of transport;

 

3.0.14.

to make proposals on the coordination of activities of bodies within the structure of the Ministry and its subordinate bodies in the field of transport;

 

3.0.15.

to prepare drafts of organizational and administrative documents in connection with state policy and legal regulation in the field of transport;

 

3.0.16.

to make proposals on the formation of a tariff policy in the relevant field, as well as on tariffs for services whose tariffs are not regulated by the state;

 

3.0.17. 

to monitor the fulfillment of obligations arising from international treaties in the field of transport to which the Republic of Azerbaijan is a signatory;

 

3.0.18.

to perform other duties as provided for in the legislation.

 

4.

Rights of the Department

 

4.0.

The Department has the following rights to fulfill its duties:

 

4.0.1.

to obtain the necessary documents, materials and information from structural units of the administrative office of the Ministry, organizations, other enterprises, departments and organizations and their authorized persons in the manner prescribed by law to carry out the tasks defined by these Regulations;

 

4.0.2.

to participate in the development of drafts of regulatory legal acts on the regulation of the transport sector;

 

4.0.3.

to make proposals on drafts of normative legal acts, international treaties, organizational and administrative documents prepared by structural units of the administrative office of the Ministry;

 

4.0.4.

to give opinions on the state policy in the field of transport, make proposals for improving legislative acts, organizational and administrative documents related to the activities of the Ministry in the field of state regulation;

 

4.0.5.

to study international experience in the field of regulation of activities in the field of transport and state policy and make proposals for improving activities in this field;

 

4.0.6.

to make proposals for training, retraining and advanced training of specialists in the field of transport;

 

4.0.7.

to participate and represent the Ministry in the work of commissions, working groups set up in the Ministry and other state bodies, local and international events (conferences, meetings and workshops) of various levels on issues related to its activities.

 

5.

Organization of activity of the Department

 

5.1.

The structure and staff number of the Department are approved by the Minister.

 

5.2.

The Department is headed by head of department, who is appointed and dismissed by the Minister.

 

5.3.

Head of Department is personally responsible for the organization of activities of the Department, carrying out the duties assigned to the Department and the implementation of rights.

 

5.4.

The Department has a deputy who is appointed and dismissed by the Minister.

 

5.5.

The deputy head of the Department is personally responsible for the performance of tasks assigned to him by the head of department and the exercise of rights.

 

5.6.

In the absence of the head of Department, the deputy head of the Department carries out his duties in the established manner.

 

5.7.

Other employees of the Department are appointed and dismissed by the Minister.

 

5.8.

Head of Department:

 

5.8.1.

organizes the activity of the Department and carries out management and supervision over its activities;

 

5.8.2.

makes distribution of division of work among the sectors included in the structure of the Department and employees, coordinates their activities and ensures the preparation of service instructions for employees of the Department, carries out annual performance assessment of its employees;

 

5.8.3.

signs action plans and other documents drawn up to provide the fulfilment of the duties assigned to the Department, as well as controls timely and efficient implementation of measures envisaged in the action plan;

 

5.8.4.

makes proposals as required by law on issues within its competence, to the leadership of the Ministry in connection with the promotion, application of disciplinary measures against department employees;

 

5.8.5.

takes appropriate measures to improve the skills of employees;

 

5.8.6.

defines issues on the department to be discussed at the Board of Ministry and submits its proposals to the leadership of the Ministry;

 

5.8.7.

provides the implementation of legislative acts and documents in a timely manner and at the appropriate level as specified in paragraph 1.2 of these Regulations by the Department;

 

5.8.8.

organizes the consideration of letters, applications, complaints and proposals received in the Department in the manner prescribed by law;

 

5.8.9.

obtains necessary information and documents from structural divisions and bodies of the Ministry to perform the duties of the Department;

 

5.8.10.

providescompliance of clerical work and confidentiality in the Department;

 

5.8.11.

represents the Department.

 

5.9.

The employees of the Department bear responsibility for the violation of the requirements of these Regulations in the manner established by law of the Republic of Azerbaijan.

 

5.10.

Each employee of the Department is responsible for confidentiality of data that is known to him and data containing state or business secret in accordance with their duties and powers.
