Department of Human Resources Management and Civil Service

I. General provisions


The Department of Human Resources Management and Civil Service  of the Ministry of Communications and High Technologies of the Republic of Azerbaijan (hereinafter -  the Department) is the structural subdivision of the  Ministry of Communications and High Technologies of the Republic of Azerbaijan (hereinafter -  the Ministry).



Within the framework of the powers granted by these Regulations, the Department carries out the organization and regulation on its activity in the areas of application of regulatory acts  in the field of civil service and labor legislation,  selection, placement of personnel for the civil service on the basis of competition or interview,  to monitor the compliance with the rules of ethical conduct  by civil servants and non-civil servant employees of  the Ministry  (hereinafter – the Employees), enhancing  professional qualifications of civil servants, their attestation and  social protection,  as well as  civil service and labor relations, human capital management exercise.



The  activity of the department  is guided by  the Constitution of the Republic of Azerbaijan, the law of the Republic of Azerbaijan “On Civil Service” and other laws, decrees and orders of the  President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, regulations on the Ministry of Communications and High Technologies of the Republic of Azerbaijan, other legislative acts, decisions of the Board of Ministry, decisions and orders (hereinafter - organizational-administrative documents)  of the Minister of Communications and High Technologies (hereinafter – the Minister) and these Regulations.



While carrying out its duties and rights the Department interacts with  structural divisions and bodies of the Ministry, central and local executive authorities, self-government bodies, and non-governmental organizations.



II. Areas of activity of the Department



The  areas of activity of the Department are as follows:



Ensures civil service and human resources, organization  and improvement of regulating  labor relations;



Carries out  methodical and practical management  for conducting  civil service and human resources in the bodies of the Ministry ;



Prepares and implements measures in the area of human capital development;



Ensures  the development of the field;



Performs in other areas of  activity as specified by law.


III. Duties of the Department



The Department performs following tasks in accordance with the directions of  activity defined by these Regulations:



To prepare drafts of  organizational and administrative documents  for the directions of activity or participate in their preparation;



To ensure the organization and implementation of activities   in  staff forecasting, formation of reserve personnel ,  maintenance of personal files of civil servants, human resources management;



To identify training needs of employees, increase professional skills,  organize measures on issues of  ethical behavior  and anti-corruption together with  relevant bodies;



To coordinate its activities in the field of staff training, re-training and professional development  of employees with  other central executive authorities of the  Ministry,  analyze the situation and prepare proposals in this area;



To submit  relevant information required for admission to civil service and for filling administrative positions timely as intended  and take necessary measures for holding auxiliary positions that are not considered   civil services;



To take  necessary measures to conduct  register of civil servants and other databases established in connection with  civil service  and ensure the provision of information on  changes occurred  in data included in the register to public authority which maintain records  every month;



To gather information about service activities of employees, update and analyze, their selection and placement through  promotion , initial and subsequent awarding professional ranks to civil servants, make use of this information in  settlement of  civil service  and other issues  related to labor contracts;



To prepare strategies, programs and other documents  on development and management of human resources for  specified  periods,  organize their implementation;



To organize the employees’ performance evaluation and appraisal;



To take total control over service performance appraisal process ;



To ensure the management  with the position of  human resources management and  data on employees’  official  activity;



To ensure effective and sustained personnel policy, objectivity in  human resource management, equality, impartiality and transparency;



To resolve proposals of heads of organizations  and  requests  of employees on transfer of employee  from one job to another   in accordance with the  legislation;



To take measures for issuance of work books , filling in work books, their registration and maintenance ;



To conduct  work on  military registration and placement;



 To take measures  to  draw up   vacation schedules and grant vacation leaves to employees in accordance with the law, conduct their registration,  mainatin records;



To prepare job descriptions for civil service positions together with heads of bodies ;



To carry out practical  and methodical management  for conducting  personnel work  in bodies,  supervise the  organization of this work within its powers;



To ensure preparation of all necessary documents for the purpose of pension provision for the Ministry employees within its  powers and their submission  to the social security bodies ;



To organize  the swearing-in ceremony of civil servants who are  admitted to the permanent civil service and  holding an administrative position in the manner prescribed by law;



To establish  relations and  implement cooperation with organizations, including scientific organizations  operating in the field of the development of human capital and  increasing the capacity ;



To ensure the consideration  of letters, applications, complaints and suggestions received  from citizens, government authorities, institutions, enterprises and organizations  and reviewing requests  in a manner as provided in the legislation;



To prepare  work plan of the Department , reports on its activities for the periods;



To perform other duties in accordance with the directions of activity as stipulated by law.



IV. Rights of the Department



  The Department  has following rights to fulfill its duties:



To participate in preparation of drafts of  legislative acts, international agreements, organizational and administrative documents  by organizations  in the  relevant field and  make relevant proposals;



To make proposals to the  management  together with relevant bodies on awarding initial and subsequent professional ranks to  civil servants depending on their position and length of service as well as taking into account their professionalism, performance of management experience and indicators in  performance of  job duties;



To give opinion on directions of activity, carry out analysis and make  general conclusions, give practical and methodological recommendations  on   human resource management  to the heads of bodies of the Ministry;



To prepare proposals for increasing the efficiency in the field of  human resources management and  elimination of shortcomings in bodies  ;



To send  relevant requests to related bodies appropriately, in connection with the performance of duties as defined by these  Regulations and obtain relevant data (documents) from them;



To organize and ensure the preparation of job descriptions;



To prepare or participate in making proposals for the regulation and improvement of  activities in the field of human resources;



The selection and appointment of employees, their admission to civil service, termination of labor contracts, rotation of staff, awarding, taking disciplinary action, send on a business trip, grant vacation time,  awarding professional ranks to civil servants, as well as prepare  relevant documents on human resource management;



To participate in holding competions and interviews  for filling  administrative positions and admission to civil service  on vacant positions  in the Ministry ;



To cooperate with other state agencies carrying out activities   in the field of human resource management in order to exchange experience;



To represent the Ministry before state bodies, local self-government agencies, legal and physical persons on issues related to its activity, protect its rights and interests;



To represent the Ministry  at the commissions, working groups established in the Ministry and other state bodies, local and international events of various levels  held on issues related to its activity and  participate in their work;



To take measures in the preparation of highly qualified personnel;



To study the experience of foreign countries in accordance with the directions of activity and  make proposals for the improvement of activities in this direction;



To carry out  other rights in accordance with the directions of activity as provided  by law.



V. Organization of the activity of the Department



The  structure and number of staff units  is approved by the Minister.



No one can interfere with the activity of the department except the person authorized by the Minister.



The department is headed by  head of  department which is  appointed and dismissed by the Minister.



Head of department is personally responsible for carrying out the duties assigned to the department and  implementation of rights.



In the absence of the head of department, one of administrative officers  carries out his duties in the prescribed manner.



Other employees of the department  are appointed and dismissed by the Minister



Head of Department:



Organizes the activities of the department and heads it;



Ensures the implementation of duties imposed on the Department;



Exercises control  over the obvservance of labor discipline by  employees of the department, supervises timely  and proper execution of their duties;



Gives binding  instructions to the employees of the Department;



Makes proposals to the Minister for taking disciplinary measures and  rewarding  for the employees of the Department ;



Represents the department  in the events held with the management of the Ministry and other events;



Employees of the Department  bear responsibility for violation of  requirements of these Regulations as envisaged by the legislation of the  Republic of Azerbaijan.



Each employee of the Department is responsible for data confidentiality  that is known to them and data containing  state or business secret in accordance with their duties and powers.
