Department of Finance and Economic Analysis

 

I. General provisions

 

1.1 

The Department of Finance and Economic Analysis (hereinafter – the Department) of the Ministry of Communications and High Technologies (hereinafter – the Ministry) of the Republic of Azerbaijan is a structural unit of the Ministry of Communications and High Technologies of the Republic of Azerbaijan.

 

1.2

Within the framework of the powers granted by these Regulations the department implements  financial and economic coordination and accounting and organization of accountability, tariff and investment policy, organization of labor and  control over its payment and economic analysis relating to the activities of structural divisions of the Ministry, bodies  included in its structure  and subordinate bodies (hereinafter – the Bodies) that are not included in its structure and determines strategical targets contributing sustainability of development in this field.

 

1.3

The activity of the department is guided by the Constitution of the Republic of Azerbaijan, the law of the Republic of Azerbaijan “On civil service” and other laws, decrees and orders of the  President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, Regulations on the Ministry of Communications and High Technologies of the Republic of Azerbaijan, other legislative acts, decisions, orders and decrees (hereinafter – organizational-administrative documents)  of the Minister of Communications and High Technologies (hereinafter – the Minister), decisions of the  Board of Ministry and these Regulations.

 

1.4 

While carrying out its duties and executing  rights the Department acts in cooperation with   structural divisions, bodies of the Ministry, central and local executive authorities, self-government bodies, international  and non-governmental organizations, as well as legal and physical persons operating in this field.

 

 

II. Areas of activity of the Department

 

2.1.

The  areas of activity of the Department are as follows:

 

2.1.1.

Organizes and implements financial and economic activity  of the  Ministry;

 

2.1.2.

Organizes and keeps records and accounting reports  in the Ministry;

 

2.1.3. 

Forms tariff policy together with the Ministry’s structural divisions  and bodies in this field, prepares appropriate proposals in this field and  takes measures for their  implementation;

 

2.1.4.

Prepares investment forecasts and takes necessary measures for their implementation;

 

2.1.5.

Supervises complience with labor organization, labor standards, conformity of number of employees with amount of work and salary payment and  prepares proposals in this field;

 

2.1.6.

Supervises the implementation of financial and economic forecasts, carries out relevant economic analysis, makes proposals for the development of the field;

 

2.1.7.

Operates in other  areas of activity as defined by law.

 

 

III.Duties of the Department

 

3.1.

The Department performs following tasks in accordance with the activities defined by these Regulations:

 

3.1.1.

To prepare proposals on the formation of finance, accounting, economy and investment policy in the field of communication and high technologies (hereinafter - relevant field) and ensure the implementation together with the Ministry’s structural divisions and bodies in the manner prescribed by law;

 

3.1.2.

To develop proposals on improvement of financial, accounting, budget, tax and customs policy in the relevant field and implement joint measures on their implementation;

 

3.1.3.

To participate in the establishment of mutual relations within its competence with communication administrations of other countries and international organizations in this area;

 

3.1.4.

To participate in the establishment of mutual relations with communication agencies having state share in charter capital in accordance with the legislation and regulations operating in the relevant field  and with state share capital;

 

3.1.5.

To participate in preparation of proposals for determining the direction of  formation of  tariff policy for telecommunication services  and improvement of tariffs by taking into account international practice together with the Ministry’s structural divisions and bodies in accordance with the current legislation;

 

3.1.6.

To supervise the correct application of tariffs in the provision of telecommunications services together with relevant departments of the Ministry;

 

3.1.7.

To prepare forecasts for organizations on socio-economic development together with relevant departments and take measures for their implementation;

 

3.1.8.

To prepare revenue and budget for bodies together with them and organize their approval with the consent from relevant executive authorities and control their implementation;

 

3.1.9.

To prepare information on the implementation of income and budget and present to relevant ministries;

 

3.1.10.

To analyze the financial and economic activity of bodies and make proposals on increasing the effectiveness of their activities;

 

3.1.11.

To prepare budget payments by tax types for organizations, payment forecasts to the State Social Protection Fund and present to related ministries;

 

3.1.12.

To supervise the implementation of timely payments to the budget and extra-budgetary funds by organizations;

 

3.1.13. 

To ensure preparation of budget estimates envisaged for the Ministry from state budget of the Republic of Azerbaijan and submitting to the Ministry of Finance;

 

3.1.14.

To take part in controlling the use of funds received through state budget, loans, grants and other sources by the Ministry for its intended purpose;

 

3.1.15.

To carry out methodological management over conducting accounting and reporting by bodies;

 

3.1.16.

To implement the organization of the Ministry’s accounting in conformity with international standards together with the bodies;

 

3.1.17.

To make proposals on improvement of the automated accounting programs applied in organizations;

 

3.1.18.

To organize accounting of   financial and economic activities in  subordinate bodies of the Ministry that are not included  in its structure, in accordance with  financial legislation and accounting rules, supervise economically use of   material, labor and financial resources and protection of state property;

 

3.1.19.

To work out initial accounting documents, accounting registers, accounting reports, accounting records and other documents regarding financial transactions;

 

3.1.20.

To supervise accounting of cash inflows, materials and fixed assets to agencies, reflection of operations on their flow in accounting documents;

 

3.1.21.

To work out periodic statements of cash flows for subordinate  bodies of the Ministry that are not included in its structure and present to  relevant  government bodies;

 

3.1.22.

To take measures together with related communications organizations and associations in the directions of making an inventory of receivables, performance according to collection norms and  related to the payment of credit debts;

 

3.1.23.

To organize making an inventory in the Ministry and evaluation and revaluation of  the property  of the Ministry in the procedure established;

 

3.1.24.

To participate in taking measures on preservation of the property of the Ministry, its effective use, accounting, and registration;

 

3.1.25.

To maintain correspondences with organizations on the management of property and coordinate activities in this field with State Committee on Property Issues and  other relevant government authorities;

 

3.1.26.

To carry out analysis in bodies with the view of prevention unnecessary expenses and losses, reveal  economic resources on the basis of  data of accounting documents and participate in taking measures for elimination of  shortcomings;

 

3.1.27.

To take measures with related departments on improvement of the activity and structure of relevant bodies;

 

3.1.28.

To participate in taking measures on improvement of social condition of employees of bodies and the Ministry;

 

3.1.29.

To organize labor organizations, wage payment,  supervise the implementation of applicable laws, orders and decrees related to social issues together with relevant departments;

 

3.1.30.

To supervise drafting of staffing schedules of organizations and their compliance with the structure;

 

3.1.31.

To draw up cost estimates of the administrative office of the Ministry and supervise their implementation;

 

3.1.32.

To prepare the structure and staffing schedule of the administrative office of the Ministry within labor payment fund established and the number of employees;

 

3.1.33.

To supervise the determination of maintenance costs of state-funded organizations and its implementation with relevant bodies;

 

3.1.34.

To ensure payment of staff salaries, travelling expenses and other payments for the employees of the Ministry;

 

3.1.35.

To prepare investment forecasts for the bodies of the Ministry together with other departments, take measures for its approval and implementation;

 

3.1.36.

To prepare proposals on projects to be financed from the state budget based on state investment for the Ministry together with structural divisions and  bodies of the Ministry and send to relevant government agencies;

 

3.1.37.

To participate in giving opinion to technical feasibility and design-estimates prepared for the purpose of building,reconstruction and modernization of communications facilities from  technical point of view ;

 

3.1.38.

To control the organization of accounting of costs related to revenues and expenses on the types of communication services together with relevant departments and agencies;

 

3.1.39.

To analyze the satisfaction of needs of population, institutions and enterprises for communication services together with relevant departments and make relevant proposals;

 

3.1.40.

To make proposals for ensuring the development of this area and its conformity with the international standards by analyzing key technical and economic parameters of the relevant field;

 

3.1.41.

To conduct comparative analysis of indicators in the relevant field with other countries and make proposals to improve performance;

 

3.1.42.

To work out monthly, quarterly and annual statistical reports on the activity of the Ministry based on  rules laid down by State Statistical Committee of the Republic of Azerbaijan, ensure their provision to statistical agencies;

 

3.1.43.

To make proposals on improvement of statistical reporting forms together with relevant departments and agencies;

 

3.1.44.

To prepare materials of the  meetings (consultations) of the Board of  Ministry held in connection with the end of each reporting period on the basis of information of  structural divisions and bodies of the administrative office of the Ministry and present to the management;

 

3.1.45.

To prepare reports on the implementation of state programs related to the Department and approved by relevant decrees and orders of the President of the Republic of Azerbaijan and present to the relevant government agencies;

 

3.1.46.

To participate in preparation of proposals related to the privatization of organizations;

 

3.1.47.

To conduct investigations and render practical assistance in places in order to control the  state of forecasting in agencies, organization of finance and economic activity, accounting and rules of wage payment;

 

3.1.48.

To participate in the preparation of annual reports on activities of the Ministry;

 

3.1.49.

To participate in the preparation of drafts, other normative legal acts and different normative  documents in the relevant field;

 

3.1.50.

To prepare opinion and proposals on drafts of normative legal documents received in the Department;

 

3.1.51.

To ensure  investigation and answering to applications and complaints received in the Department;

 

3.1.52.

To perform other duties in accordance with the directions of activity as provided for in the legislation.

 

 

IV.Rights of the Department

 

4.1.

The Department  has following rights to fulfill its duties:

 

4.1.1. 

To make proposals to the relevant government authorities on issues related to its competence;

 

4.1.2.

To formulate and implement finance, economy, accounting, investment, wages policies of the Ministry;

 

4.1.3.

To supervise the execution of revenue and expense budgets of socio-economic development forecasts, make proposals and recommendations to  organizations for  elimination of forecast deviations and raise issue  before the management in this regard;

 

4.1.4.

To give opinion  and suggestions  on  draft documents (letter, reference, inquiries etc.) prepared by bodies;

 

4.1.5.

To give opinion  and make proposals according to the areas of activity, make analyses and summarization, prepare analytical materials, make proposals on improvement of legislative acts and  organizational-administrative documents in the field of finance, accounting and other relevant areas;

 

4.1.6.

To send relevant requests to organizations within its powers  for the implementation  of duties determined by these Regulations and obtain related  information (documents) from them;

 

4.1.7.

To participate in the  discussions on issues related to the functions of the department, work of  commissions, consultative and coordinating bodies created in the Ministry and organizations  taking into account the requirements of legislation;

 

4.1.8.

To maintain correspondences with bodies, as well as other concerned organisations within its powers;

 

4.1.9.

To implement other rights set forth in the legislation according to the areas of activity.

 

 

V.Organization of the activity of the Department

 

5.1.

The  structure and  number of staff units of the Department  is approved by the Minister.

 

5.2..

No one can interfere with the activity of the Department except the person authorized by the Minister.

 

5.3.

The structure of the Department includes Financial Sector and Accounting Sector.

 

5.4.

The Department is headed by  head of  department which is  appointed and dismissed by the Minister.

 

5.5.

Head of Department is personally responsible for organization of activities of the Department, carrying out the duties assigned to the Department and the implementation of rights.

 

5.6.

Financal sector  and Accounting sector  are headed by heads of  sector which are  appointed and dismissed by the Minister.

 

5.7.

Heads of sector are personally responsible for carrying out the duties and the implementation of rights assigned to them as provided by these Regulations and the head of Department ;

 

5.8.

In the absence of the head of Department, one of  heads of sector  carries out his duties in the established manner.

 

5.9.

Other employees of the Department  are appointed and dismissed by the Minister

 

5.10.

Head of Department:

 

5.10.1.

Organizes the activity of the Department and carries out management and supervision over its  activities;

 

5.10.2.

Makes distribution of division of work among the sectors included in the structure of the Department and employees, coordinates their activities  and ensures preparation of job descriptions of department employees;

 

5.10.3.

Controls performance of duties, labor and  performance discipline by employees of the Department;

 

5.10.4.

Signs action plans and other documents drawn up in order to ensure the fulfilment of the duties assigned to the Department, as well as controls  timely and efficient implementation of measures envisaged in the action plan and reports to the management of the Ministry on its implementation;

 

5.10.5.

Defines issues on the department to be discussed  at the Board of Ministry and  presents its proposals on it  to the management  of the Ministry;

 

5.10.6.

Ensures the implementation of relevant measures provided in legislative acts, decisions of the Board of the Ministry and organizational-administrative documents in a timely manner and at the appropriate level as  specified in paragraph 1.2 of these Regulations by the department;

 

5.10.7.

Makes proposals to the management of the Ministry regarding appointment and dismissal of employees of the Department, their stimulation, taking of disciplinary measures, as well as removal of the employees from their positions;

 

5.10.8.

Makes proposals to the management of the Ministry  on participation of employees in courses and trainings in order to provide the Department with  high-qualified specialists,  increasing the professional skills of employees and staff appointments;

 

5.10.9.

Obtains  necessary information and documents from structural divisions  and bodies of the Ministry within its  competence to perform the duties of the Department;

 

5.10.10.

Organizes reviewing and timely and correctly answering  letters, applications, complaints and suggestions received in the Department in accordance with the legislation;

 

5.10.11.

Ensures compliance of clerical work in the Department with the “Instructions on conducting clerical work in  government agencies, legal entities, budget organizations whose control envelope  of  shares (stocks) belongs to the state”;

 

5.10.12. 

Ensures privacy in the Department and bears responsibility for ensuring  protection measures of state secrets in the activity of department;

 

5.10.13.

Signs the letters sent to  central and local executive bodies, as well as legal and physical persons;

 

5.10.14.

Coordinates the activity of the Department with  structural divisions and bodies of the Ministry;

 

5.10.15.

Gives binding instructions  within its competence, organizes and supervises their implementation;

 

5.10.16.

Approves relevant reports of  the Department;

 

5.10.17.

Assigns the execution of documents of particular importance and compound documents to several  employees or transfers their execution  from one  employee to another ;

 

5.10.18.

Takes necessary measures relating to giving salaries,  traveling expenses and allowances to the employees of the Ministry, receiving funds from banks and spending them to its destination in order to determine the activity of the Ministry;

 

5.10.19.

Makes proposals on recruitment and proper placement of personnel in the field of finance, economy, accounting and investment on proper placement and dismissal;

 

5.10.20.

Participates in meetings of the Board of Ministry, relevant conferences, gatherings and meetings of scientific-technical council;

 

5.10.21.

Implements the tasks of the management of the Ministry regarding the activities of the Deparment;

 

5.10.22.

Represents the Ministry in the higher authorities, other ministries, central and local executive bodies and state bodies,  international organizations, foreign countries on the instruction of the management of the Ministry and protects its interests;

 

5.10.23.

Represents the Department.

 

5.11.

Employees of the Department  bear responsibility for the violation of requirements of these Regulations as envisaged by the legislation of the  Republic of Azerbaijan.

 

5.12.

Each employee of the Department is responsible for data confidentiality  that is known to them and data containing  state or business secret in accordance with their duties and powers.

 

 

VI. Duties of Financial Sector which is included in the structure of the Department

 

6.1.

Duties of the Financial Sector are as  follows:

 

6.1.1.

To prepare forecasts on socio-economic development for organizations together with relevant departments and take measures for their implementation;

 

6.1.2.

To prepare revenue and budget estimates for bodies together with them and organize their approval with the consent from relevant executive authorities and control  their implementation;

 

6.1.3.

To prepare information on the implementation of revenue and budget estimates, present to the relevant ministries;

 

6.1.4.

To prepare budget payments by tax types for organizations, payment forecasts to the State Social Protection Fund and present to related ministries;

 

6.1.5.

To ensure preparation of budget estimates envisaged for the Ministry from state budget of the Republic of Azerbaijan and submitting to the Ministry of Finance;

 

6.1.6.

To take measures together relevant departments regarding the improvement of the activity and structure of the bodies;

 

6.1.7.

To participate in taking measures on improvement of social condition of employees of bodies and the administrative office of the Ministry;

 

6.1.8.

To organize labor organizations, wage payment, supervise the implementation of laws in force, orders and decrees related to social issues together with relevant departments;

 

6.1.9.

To supervise drafting and compliance of staffing schedules of organizations according to their structure;

 

6.1.10.

To draw up cost estimates of the administrative office of the Ministry and supervise their implementation;

 

6.1.11. 

To prepare the structure and staffing schedule  of the administrative  office of the Ministry within labor payment fund established and number of employees;

 

6.1.12.

To supervise the determination of maintenance costs of state-funded organizations and its implementation with relevant bodies;

 

6.1.13.

To prepare investment forecasts for the bodies together with other departments, take measures for its approval and implementation;

 

6.1.14.

To prepare proposals on projects to be financed from the state budget based on state investment for the Ministry together with structural divisions and bodies of the Ministry and send to relevant government agencies;

 

6.1.15.

To conduct investigations and render practical assistance in places in order to control the  state of forecasting in agencies, organization of finance and economic activity and accounting, application of tariffs properly and rules of wage payment;

 

6.1.16.

To participate in giving conclusion to technical feasibility and design-estimates prepared for the purpose of building, reconstruction and modernization of communications facilities from  technical point of view ;

 

6.1.17.

To participate in preparation of proposals for determining the direction of formation of tariff policy for telecommunication services and improvement of tariffs by taking into account international practice in accordance with the current legislation;

 

6.1.18.

To make proposals for ensuring the development of this area and its conformity with the international standards by analyzing key technical and economic parameters of the relevant field;

 

6.1.19.

To conduct comparative analysis of indicators in the relevant field with countries of the world and make proposals on improvement of the performance;

 

6.1.20.

To prepare materials of the  meetings (consultations) of the Board of  Ministry held in connection with the end of each reporting period on the basis of information of  structural divisions and bodies of the administrative office of the Ministry and present to the management;

 

6.1.21.

To prepare reports on the implementation of state programs related to the Department and  approved by  relevant decrees and orders of the President of the Republic of Azerbaijan and  present to the relevant government agencies;

 

6.1.22.

To participate in the preparation of annual reports on activities of the Ministry;

 

6.1.23.

To make proposal to the head of the Department on issues related to work plan  for the sector in accordance with the directions of activity, draft reports on work done for the periods and issues that are to be  discussed  at the Board of Ministry;

 

6.1.24.

To perform other duties in accordance with the directions of activity as stipulated by law.

 

 

VII. Duties of Accounting Sector which is included in the structure of the Department

 

7.1.

Duties of the Accounting Sector are as  follows:

 

7.1.1.

To supervise the implementation of timely payments to the budget and non-budget funds by organizations;

 

7.1.2.

To carry out methodological management over conducting accounting and reporting by bodies;

 

7.1.3.

To implement the organization of the accounting on the Ministry in conformity with international standards together with bodies;

 

7.1.4.

To analyze the financial and economic activity of bodies and make proposals on increasing the effectiveness of their activities;

 

7.1.5.

To participate in controlling the use of funds received by the Ministry through state budget, loans, grants and other sources for its intended purpose ;

 

7.1.6.

To make proposals on improvement of the automated accounting programs applied in organizations;

 

7.1.7.

To organize accounting of   financial and economic activities in  subordinate bodies of the Ministry that are not included  in its structure, in accordance with  financial legislation and accounting rules,  supervise economically use of   material, labor and financial resources and protection of state property;

 

7.1.8.

To ensure payment of staff salaries, travelling expenses and other payments for the employees of the Ministry;

 

7.1.12.

To take measures together with relevant bodies in the directions on making an inventory of receivables, performance according to collection norms and  payment of credit debts;

 

7.1.13.

To organize making an inventory in the Ministry and evaluation, revaluation of the property of the Ministry in the procedure established;

 

7.1.14. 

To participate in taking measures on preservation of the property of the Ministry, its effective use to its destination, accounting, and registration;
Use of the Ministry of preservation of the property, making effective use of, registration, registration to participate in the measures;

 

7.1.15.

To prepare materials of the  meetings (consultations) of the Board of  Ministry held in connection with the end of each reporting period on the basis of information of  structural divisions and bodies of the administrative office of the Ministry and present to the management;

 

7.1.16.

To prepare reports on the implementation of state programs related to the Sector and approved by relevant decrees and orders of the President of the Republic of Azerbaijan and present to the relevant government agencies;

 

7.1.17.

To participate in the preparation of annual reports on activities of the Ministry;

 

7.1.18.

To make proposal to the head of the Department on issues related to work plan  for the sector in accordance with the directions of activity, draft reports on work done for the periods and issues to be  discussed  at the Board of Ministry;

 

7.1.19.

To implement other rights set forth in the legislation according to the areas of activity.
